Appeals Court Rules Students at Fake Michigan University Can Sue U.S. Government

An appeals court has ruled that students who were enrolled in the fake University of Farmington in Michigan have the right to sue the U.S. government. The university was established by Immigration and Customs Enforcement (ICE) and the U.S. government as part of a sting operation targeting student visa fraud.

The students, primarily from India, allege that they were unwittingly recruited to the sham institution by government agents. They claim they were misled into believing that paying the $11,000 annual tuition would grant them legal student visas and allow them to stay in the United States lawfully. However, the university was merely a front for a federal operation to expose and arrest those involved in visa fraud.

Following the operation, at least 250 students were arrested and deported, leading to a class-action lawsuit against the U.S. government. The plaintiffs argue that they were victims of entrapment and deception by federal authorities. In 2022, the lawsuit was dismissed on technical grounds, a decision that has now been overturned by the appeals court.

The appeals court’s ruling reinstates the lawsuit and transfers it back to the Claims Court for further proceedings. This decision offers a new avenue for the affected students to seek redress and potentially hold the government accountable for the controversial sting operation.

The operation and subsequent arrests drew widespread criticism from immigration advocates and legal experts, who argued that the students were unfairly targeted and entrapped.
