Los Angeles DA Challenges Menendez Brothers’ Defense in Push for Release

Los Angeles County District Attorney Nathan Hochman is voicing skepticism over the latest efforts by Erik and Lyle Menendez to secure their release from prison. The Menendez brothers, who have served nearly 35 years behind bars for the 1989 murders of their parents in their Beverly Hills mansion, argue that their life sentences should be reconsidered due to alleged sexual abuse they suffered at the hands of their father, José Menendez.

In a recent interview with Deadline, Hochman questions a central claim in the brothers’ defense: that the allegations of abuse were not adequately addressed during their 1995 trial. The Menendez brothers have long maintained that years of physical, emotional, and sexual abuse by their father drove them to kill both him and their mother, Kitty Menendez, in what they describe as an act of self-defense and desperation.

The new district attorney in Los Angeles County is voicing his skepticism about the Menendez brothers’ push to get out of prison. Lisa Taylor has more.

Attorney Mark Geragos, who represents the Menendez brothers, insists that the original trial failed to properly consider the abuse allegations, and that new evidence has come to light supporting their claims. Geragos argues that the brothers deserve a new trial or at least reconsideration of their sentences. He points to the evolving understanding of abuse and trauma since the 1990s, which he says should now play a pivotal role in reevaluating the case.

DA Nathan Hochman says he’s taking a different approach to the case

Hochman, however, remains unconvinced. The newly elected district attorney rejects the assertion that the 1995 trial ignored the abuse claims. He notes that the allegations were brought up during the trial and that the jury was aware of them when it reached its decision. Hochman suggests that the defense’s renewed focus on the abuse claims is a strategic attempt to sway public opinion and reopen a case that has already been thoroughly adjudicated.

The Menendez brothers’ trial captured national attention in the 1990s, becoming one of the most infamous criminal cases in American history. Their defense argued that the brothers acted out of fear for their lives, while prosecutors painted them as greedy and calculating, motivated by their parents’ substantial wealth. The case became a media spectacle, influencing perceptions of abuse, privilege, and justice.

In recent years, public interest in the Menendez brothers’ story has surged, fueled in part by documentaries, podcasts, and a new generation of advocates questioning whether justice was truly served. Social media campaigns and petitions have called for a review of their case, with some framing the brothers as victims of an outdated legal system that failed to understand the complexities of abuse and trauma.

Despite this growing support, Hochman’s stance suggests that the road to a potential release will be fraught with legal and political challenges. As district attorney, Hochman indicates he will carefully evaluate any new evidence presented but cautions against rewriting history based on public sentiment or modern reinterpretations of past events.

The Menendez brothers remain imprisoned on life sentences without the possibility of parole. Their case continues to spark debate over the intersection of justice, trauma, and societal change, as advocates push for greater recognition of the long-term effects of abuse in criminal proceedings.
