The U.S. Department of Justice (DOJ) has consented to temporarily refrain from publicly disclosing the identities of FBI agents who participated in the investigations of the January 6, 2021, Capitol attack. This decision comes amid ongoing legal proceedings initiated by FBI personnel concerned about potential safety risks and retaliation.
The agreement, formalized through a consent order, stipulates that the federal government will not release the list of agents’ names until the court rules on the plaintiffs’ anticipated motions for a preliminary injunction. Additionally, should the DOJ decide to make the list public in the future, it is required to provide the plaintiffs with a two-business-day notice, allowing them the opportunity to seek further legal protection.
This legal action was prompted by a directive from Acting Deputy Attorney General Emil Bove, who requested a comprehensive list of FBI employees involved in the January 6 investigations. The request raised concerns among agents about potential mass terminations and public exposure, especially in light of President Donald Trump’s previous criticisms of the FBI’s handling of the Capitol riot investigations.
In response to the DOJ’s request, Acting FBI Director Brian Driscoll provided detailed information about approximately 5,000 to 6,000 agents, including employee numbers and job roles, while initially withholding names to protect their identities. However, under continued pressure, the FBI eventually submitted the names through a classified information system.
The FBI Agents Association expressed relief at the court’s intervention, emphasizing the importance of safeguarding agents’ identities to prevent potential harassment or threats. They highlighted the critical role these agents play in national security and public safety, underscoring the need for their protection.
As the situation evolves, the court’s forthcoming decisions will be pivotal in determining the balance between governmental transparency and the protection of federal employees involved in sensitive investigations.
