New York state has secured a significant legal victory against United Health Care, the largest health care provider in the country, for failing to provide birth control coverage to patients. This landmark case underscores the state’s commitment to enforcing its comprehensive contraception coverage laws.
The lawsuit originated from a complaint received by the Attorney General’s office, where a patient in Brooklyn reported being denied coverage for their oral contraception. This denial was found to be in direct violation of New York’s Comprehensive Contraception Coverage Act, which mandates that health insurance providers cover all FDA-approved contraceptive methods without cost-sharing.
As a result of the lawsuit, United Health Care has been ordered to pay a $1 million penalty to the state. Additionally, the insurance giant must refund customers who were denied coverage and subsequently had to pay out of pocket for their contraception.
