The movement has gained momentum with the backing of Texas Senator Ted Cruz, who is championing the “Take It Down Act.” The proposed legislation would impose stricter penalties on individuals who create and distribute such content.
Elliston Berry, a 15-year-old from Texas, has become a vocal advocate for the bill after being targeted by a deepfake image that falsely depicted her in the nude. Berry says the emotional toll of the incident has been profound, while the teen responsible for creating the image faced minimal legal consequences. “They get a slap on the wrist while we have to live with the stigma forever,” Berry said, reflecting on the lack of accountability under current laws.
The Take It Down Act seeks to address these gaps by making it a federal crime to produce or distribute deepfake pornography. Under the proposed law, creators could face up to two years in prison if the victim is an adult and up to three years if the victim is a minor. The bill has garnered bipartisan support, with lawmakers on both sides of the aisle emphasizing the need to protect victims from the long-lasting harm caused by these images.
Deepfake technology, while innovative, has increasingly been weaponized to harass and exploit individuals, particularly women and minors.
